1. Use of Website

All deliverables are based on the information provided by the client. We are not responsible for inaccuracies resulting from incomplete or incorrect information supplied by the client.

3. Client Responsibilities

Clients agree to:

• Provide accurate project details, brand assets, and account access where required
• Respond promptly to communication and revision requests
• Review and approve deliverables within agreed timelines
• Ensure they hold the rights to any content, images, or materials they supply
• Maintain their own platform accounts (hosting, domains, ad accounts, phone numbers) unless explicitly agreed otherwise

4. Payments & Refund Policy

• Payments must be made according to the agreed proposal or invoice schedule.
• Work may begin only after receipt of the required advance payment.
• Monthly services (marketing, AI reception) are billed in advance and renew automatically unless cancelled with notice.
• Payments are non-refundable once work has commenced unless otherwise stated in writing.
• Third-party costs (ad spend, hosting, software licenses, telephony) are billed separately and are non-refundable.
• Delays in payment may result in project or service suspension.

5. Revisions & Changes

Reasonable revisions are included as outlined in your project agreement. Additional revisions or major scope changes may incur extra charges and revised timelines.

6. Intellectual Property

All designs, code, content, and files created by Brixon Labs Digital remain our intellectual property until full payment is received. Upon full payment:

• Clients receive rights to use the final deliverables for their intended business purposes.
• Reselling or redistributing our work without written permission is prohibited.
• We may showcase completed work in our portfolio unless confidentiality is agreed in writing.

7. Marketing & AI Performance Disclaimer

While we apply proven strategies and best practices, results from marketing campaigns, search rankings, and AI-assisted communication depend on factors outside our control (platform algorithms, market conditions, caller behavior). Specific outcomes are not guaranteed unless expressly stated in a written agreement. AI reception services depend on third-party telephony and AI providers, and occasional service interruptions may occur.

8. Limitation of Liability

Brixon Labs Digital shall not be liable for:

• Losses caused by third-party platforms, hosting providers, or service outages
• Delays caused by third parties or by client-side approval delays
• Any indirect or consequential damages resulting from use of our services

Our total liability shall not exceed the amount paid for the specific service.

9. Third-Party Services

We may integrate or recommend third-party tools and vendors (hosting, payment processors, ad platforms, AI and telephony providers). Such parties operate independently, and we are not responsible for their actions, services, or results.

10. Termination

We reserve the right to terminate or suspend services if:

• Terms are violated
• Payments are overdue
• Client communication ceases for an extended period

In such cases, completed work up to termination will be delivered upon payment for work performed.

11. Privacy

Use of our website and services is also governed by our Privacy Policy. Please review it to understand how we collect and use your data.

12. Changes to Terms

We may update these Terms at any time. Updated versions will be posted on this page with a revised effective date. Continued use of our website or services indicates acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the State of Texas, USA, without regard to conflict of law principles.
